Vehicles are sold with the reasonable protections afforded to the customer by the Consumer Rights Act 2015.

Where relevant we work with a panel of 3rd party warranty providers (eg, Autoprotect, Centurion), selected vehicles may be offered with the additional benefit of a 3rd party warranty (please enquire), where relevant these may be extended at the customers cost (again, please enquire). Vehicles warrantied in this way, will be highlighted in their description. Because of the type of cars we sell (eg, modified, classics etc) all other vehicles do not come with any extended warranty.

Certain vehicles may be excluded from any protections afforded by the Consumer Rights Act 2015, (due to age, mileage, condition etc) and will be advertised as “sold as seen” etc, when these vehicles are sold no warranties or protections are given or implied, they are sold on a 'sold as seen / trade sale / spares or repair’ basis. For the avoidance of any doubt, the small minority of buyers who think they can buy a “sold as seen” car, on the cheap and then down the line try to use the protections of the Consumer Rights Act etc, you can not. In the unlikely event that we sell a car that does not meet usual high retail standards, it will be advertised and sold as “sold as seen for spares and repair.” Please therefore assume that nothing works, everything has a fault, it should not be driven on the road and must be removed on a trailer. If you proceed with the purchase and choose to drive it home etc, you will be asked to sign that you accept the risks and understand the above. In short you can’t have it both ways, ie buy a cheap “sold as seen” car and have all the same legal protections as a “retail“ customer. The customer will be asked to sign indicating they understand and accept this.

Customers are respectfully reminded, that where the vehicles sold are classic / collectors / hand built / classic sports cars / track cars / kit cars / modified cars, etc. it may not be suitable for “everyday” use, and may not be to the manufacturers original specification. In short it may not be reasonable to expect it to achieve the same level of reliability and safety as a modern vehicle. By proceeding to purchase it is assumed the customer understands this.

Where possible, every vehicle (except those advertised as ‘sold as seen / trade sale’ as above) will benefit from a comprehensive 94 point independent Pre-Delivery Inspection (PDI), or will have a fresh MOT. 

Every vehicle (except those advertised as ‘sold as seen / trade sale’ as above) will have at least 6 months MOT or have a new PDI, and be in the first half of the mileage service interval before its next routine service is due. Where the vehicle (except those advertised as ‘sold as seen / trade sale’ as above) is advertised for sale with an MOT of less than 6 months remaining and / or has completed more than 50% of its routine service interval mileage since its last service, we will at our cost MOT and / or PDI, and independently service the vehicle before selling it to you. Whilst every effort is made to ensure quoted vehicle mileages are accurate, using MOT / service history / on line services etc, we can never guarantee (nor can any other used car dealer) that quoted / odometer mileages are accurate.

We seek to prepare all our vehicles to a high standard, as if we were purchasing them ourselves. As such we welcome any AA / RAC / mechanical inspection you may wish to arrange (at your cost) on the vehicle prior to purchase / end of auction. 

We always seek to describe our vehicles honestly and accurately, using certain subjective terms to help you to understand our view of condition etc. It is not in our interests to mis-describe vehicles, wasting your and our time, buyers are reminded however to satisfy themselves of the vehicle's condition and description prior to purchase. 

Viewings / accompanied test drives by appointment are welcomed, but must take place prior to any auctions (if relevant) ending. 

Just as you would expect us to honour the price we agree with you, you are required to do likewise. The final price at auction end / that we agree with you is the purchase price, and customers are required to pay the final price at auction end / the price agreed and not seek to re-negotiate a price already bid / agreed. 

Whilst many of our customers happily buy from us online without them having viewed the vehicle before purchase, we don’t operate an organised distance selling scheme. You are therefore reminded that if you purchase a used vehicle without having viewed it before purchase, you will not be entitled to cancel your order under the Consumer Contracts Regulations 2013. If you are entitled to return to us a vehicle that you viewed prior to purchase, you will bear the costs of the return and a deduction in the value of the vehicle will be made by us if its value has reduced whilst in your care. Vehicles that have been modified, altered, renovated, or in any way personalised prior to collection at the customers request, can not be returned.

Winning bidders / purchasers are required, within 24 hours of auction ending / of us sending to you written confirmation of agreed price or viewing, to pay a £250 or 10% of the agreed purchase price (which ever is the greater) deposit via bank transfer. If the deposit is not paid within this 24 hour period, we reserve the right to re-advertise and / or sell the vehicle elsewhere without further notice at our discretion. Where a vehicle is sourced and bought in for a customer, the above deposit is required, prior to us buying in the potential agreed vehicle. The balance of the agreed price is to be paid upon collection (which must take place within 7 calendar days of auction ending or of us sending to you written confirmation of agreed price / or confirmation it is prepared and ready for collection, unless we have agreed a different time period). The balance is to be paid in full in cash or bank transfer upon collection, cleared funds will be required prior to the vehicle being released. Vehicles to be delivered require payment in full prior to departure. A word of cautionary experience: bank transfers can sometimes take a few hours to come through. If the balance is not paid within 7 calendar days/the time period we have agreed (as above), we reserve the right to re-advertise and/or sell the vehicle elsewhere without further notice at our discretion and the £250 / 10% of purchase price deposit will be forfeit (and thus not returnable to you) in recognition of the additional expenses incurred by us in you failing to buy the vehicle as agreed. 

Our vehicles are advertised via a number of outlets, as such any vehicle can be removed from sale at any time prior to a deposit being paid to secure. By bidding in an auction and / or making an offer on a vehicle you are confirming you understand and agree to these terms and conditions.

There are a number of circumstances where we may agree to vehicles being left with us, this will be on a case by case basis and agreed in advance. Those left without agreement, eg. purchased but not collected, unsold commission sales cars, cars where payment for repairs is outstanding etc will incur additional charges. Storage and indeed cash flow is not free, as such, any vehicle left with us without agreement for more than 7 days, will then incur storage costs of £20 a day, and outstanding balances will incur an interest charge of the prevailing Bank of England base rate +5%. In the event that any outstanding balances have not been paid (including storage fees and interest) / the vehicle removed after a further 3 months, it will be disposed off and our costs taken from the proceeds.

Your statutory rights remain unaffected.
